Terms of Service for Space of Mind

These Terms of Service ("Terms") govern your use of Space of Mind ("Company," "we," "us," or "our"), a mental fitness training app that combines AI-powered pattern recognition, evidence-based coaching, and therapist collaboration to help you build measurable mental fitness. By creating an account, using the Service, you ("User," "you," or "your") agree to these Terms.
Please note: Space of Mind's Services are intended for general wellness and mental fitness purposes only and are designed for adults aged 18 and over. Space of Mind does not provide professional medical, psychiatric, or psychological treatment, diagnosis, or care. Our Service is designed to complement, not replace, professional therapy or medical care.
1. Definitions
"Service": The Space of Mind platform, including:
Daily mental fitness training protocols
AI-powered pattern recognition and personalized coaching
Conversation recording and analysis features (where enabled)
Future-Self Training™ methodology and related tools
Therapist collaboration features (where applicable)
Progress tracking and outcome measurement tools
Mobile application, web platform, and any related services
"User": An individual who creates an account, subscribes to the Service, or opts in via text message to receive communications from Space of Mind.
"User Content": Any information, data, text, audio recordings, messages, feedback, or other content you submit, upload, or transmit through the Service, including:
Voice recordings and transcriptions
Therapy session recordings (with appropriate consent)
Journal entries and reflections
Pattern data and progress metrics
Feedback and communications
"Therapist Partner": A licensed mental health professional who uses Space of Mind's professional features to support their clients.
"Professional Account": A subscription tier designed for licensed therapists, coaches, or mental health professionals to manage and support clients using Space of Mind.
2. Registration and Service Access
2.1 Account Creation
To use the Service, you must:
Be at least 18 years of age
Provide accurate, current, and complete information during registration
Maintain and update your account information
Keep your login credentials confidential
Notify us immediately of any unauthorized access
2.2 Subscription Tiers
Premium Tier ($29/month):
Full daily training protocol
Voice journaling with transcription
Advanced pattern analysis
Progress tracking
2.3 Therapist-Referred Access
If you are referred by a Therapist Partner:
Your therapist may have access to your progress data (with your consent)
Your subscription may be sponsored by your therapist or covered by insurance
You can revoke therapist access at any time through your account settings
3. Term and Termination
3.1 Term
These Terms remain in effect while you use the Service. Subscriptions renew automatically unless cancelled.
3.2 Cancellation
You may cancel your subscription at any time:
Through your account settings

Cancellation takes effect at the end of your current billing period. No refunds for partial periods.
3.3 Account Deletion
To permanently delete your account and data:
Request deletion through account settings
Upon deletion, your account and associated User Content will be permanently erased from our live databases within 30 days, except as required by law or as specified in our Privacy Policy.
3.4 Termination by Company
We may suspend or terminate your access to the Service at any time for:
Violation of these Terms
Fraudulent or illegal activity
Abusive behavior toward the Service, staff, or other users
Non-payment (for paid subscriptions)
Any reason at our sole discretion
We are not liable for any losses resulting from account suspension or termination.
4. Use of Service
4.1 Permitted Use
You may use the Service for:
Personal mental fitness training and development
Recording and analyzing your own conversations (with appropriate consent)
Tracking your behavioral patterns and progress
Complementing professional therapy or coaching (where applicable)
4.2 Prohibited Conduct
You may not:
Use the Service if you are under 18 years of age
Provide false or misleading information
Share your account credentials with others
Use the Service for any illegal purpose
Attempt to reverse engineer, hack, or disrupt the Service
Use offensive, discriminatory, harassing, or abusive language
Record conversations without consent of all parties (where required by law)
Share or distribute User Content that violates others' privacy or rights
Impersonate another person or misrepresent your affiliation
Use the Service to provide professional therapy or medical advice (unless you are a licensed professional using Professional features appropriately)
Scrape, data mine, or use automated tools to extract data from the Service
Violations may result in immediate suspension or termination of your account.
5. AI-Powered Features and Limitations
5.1 How the service works
Space of Mind uses artificial intelligence to:
Analyze your thought patterns and identify cognitive distortions
Recognize limiting beliefs from your User Content
Provide personalized mental fitness training recommendations
Track behavioral changes and progress over time
Facilitate "conversations" with your Future Self (AI-generated guidance)
Generate insights from recorded conversations (with your consent)
5.2 Limitations of AI
You acknowledge and understand that:
AI recommendations are generated by algorithms, not human professionals
AI analysis may be incomplete, inaccurate, or inappropriate for your situation
The Service cannot detect all patterns or predict all outcomes
AI-generated "Future Self" conversations are simulations based on your inputs, not actual future predictions
Conversation analysis is probabilistic and may miss important context
5.3 Not a Substitute for Professional Care
IMPORTANT: Space of Mind is a mental fitness training tool, not a replacement for:
Psychotherapy or counseling
Psychiatric treatment or medication management
Crisis intervention or emergency services
Medical diagnosis or treatment
Legal, financial, or other professional advice
If you are experiencing a mental health crisis, suicidal thoughts, or medical emergency:
Call 988 (Suicide & Crisis Lifeline)
Call 911 (Emergency Services)
Go to your nearest emergency room
Contact your therapist or psychiatrist immediately
The Service may provide crisis resources but is not equipped to handle emergencies.
6. Conversation Recording and Analysis
6.1 Recording Features
The Service allows you to record:
Therapy sessions (with therapist consent)
Coaching calls
Personal conversations (with all parties' consent)
Voice journals and reflections
6.2 Consent Requirements
YOU ARE SOLELY RESPONSIBLE FOR OBTAINING CONSENT BEFORE RECORDING ANY CONVERSATION.
By using recording features, you represent and warrant that:
You have obtained explicit consent from all parties being recorded
You comply with all applicable federal, state, and local recording laws
You understand that some jurisdictions require all-party consent for recording
Failure to obtain proper consent may result in:
Civil or criminal liability
Immediate termination of your account
Legal action against you
We are not responsible for your failure to obtain proper consent.
6.3 Analysis and Processing
Recorded conversations may be:
Transcribed using automated speech recognition
Analyzed for patterns, emotions, and cognitive distortions
Used to personalize your training protocol
Processed by third-party AI providers (see Section 8)
You can mark segments as "do not analyze" to exclude sensitive content.
6.4 Therapist Access
If you have granted access to a Therapist Partner:
They may view transcriptions, pattern analysis, and progress data
They cannot access raw recordings without additional consent
You can revoke access at any time through account settings
7. Privacy and Data Protection
7.1 Data We Collect
We collect:
Account information (name, email)
User Content (recordings, transcriptions, journal entries)
Pattern data (identified beliefs, behavioral metrics, progress tracking)
Usage data (features used, session duration, engagement metrics)
Device information (IP address, browser type, operating system)
7.2 How We Use Your Data
Your data is used to:
Deliver and personalize the Service
Improve AI algorithms and pattern recognition (where permitted)
Generate progress reports and insights
Facilitate therapist collaboration (with your consent)
Ensure safety and prevent abuse
Comply with legal obligations

7.3 Data Security
We implement:
End-to-end encryption for recordings and sensitive data
Secure cloud storage with industry-standard protections
Regular security audits and updates
Access controls and authentication
However, no system is 100% secure. You use the Service at your own risk.
7.4 Data Retention
Active account data: Retained while your account is active
Deleted account data: Permanently erased within 30 days of deletion request
Legal retention: Some data may be retained longer as required by law
Aggregated data: Anonymized, non-identifiable data may be retained indefinitely for research and improvement
8. Third-Party Services
8.1 AI Processing Providers
User Content is processed by third-party AI providers, including but not limited to:
OpenAI (GPT models)
Amazon Web Services
Deepgram (transcription)
These providers operate under their own privacy policies and security standards. By using the Service, you consent to this processing.
8.2 Payment Processing
Payments are processed by Stripe or other third-party payment processors. We do not store your complete credit card information.
8.3 Analytics and Monitoring
We use third-party analytics tools (e.g., Google Analytics, Mixpanel) to understand usage patterns and improve the Service.
8.4 No Endorsement
We do not endorse or control third-party services and are not responsible for their practices or failures.
9. Therapist Partner Terms
9.1 Professional Licensing
Therapist Partners must:
Hold a current, valid license to practice (LCSW, PhD, PsyD, LMFT, LPC, or equivalent)
Comply with all applicable professional ethics codes and regulations
Maintain appropriate malpractice insurance
Use the Service only within their scope of practice
9.2 Client Relationships
Therapist Partners acknowledge that:
Space of Mind is an adjunct tool, not a replacement for professional judgment
They remain solely responsible for their clients' care and treatment
They must obtain appropriate consent before inviting clients to use the Service
Client data accessed through the Service is subject to HIPAA and other privacy laws
9.3 Professional Conduct
Therapist Partners must not:
Use the Service to provide emergency or crisis intervention
Rely solely on AI analysis for clinical decisions
Share client data inappropriately
Use the Service in ways that violate professional ethics
9.4 Suspension and Termination
We may suspend or terminate Therapist Pro accounts for:
Loss of professional license
Ethical violations or misconduct
Misuse of client data
Violations of these Terms
10. Intellectual Property
10.1 Company Ownership
Space of Mind owns all rights to:
The Service, including all software, algorithms, and AI models
Future-Self Training™ methodology and related IP
Trademarks, logos, and branding
Aggregate, anonymized data and insights
10.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to:
Access and use the Service for personal, non-commercial purposes
Download and use the mobile application on your devices
You may not:
Copy, modify, distribute, or create derivative works
Reverse engineer or decompile the Service
Remove copyright or proprietary notices
Use the Service for commercial purposes without permission
10.3 User Content License
By submitting User Content, you grant Space of Mind:
A worldwide, royalty-free, non-exclusive license to:
Use, store, and process your User Content to provide the Service
Analyze User Content to improve AI algorithms
Create aggregated, anonymized data for research and development
Share insights with your Therapist Partner (with your consent)
You retain ownership of your User Content. You can delete it at any time (subject to legal retention requirements).
10.4 Feedback
If you provide feedback, suggestions, or ideas:
You grant us a perpetual, irrevocable, worldwide, royalty-free license to use them
We are not obligated to compensate you or keep them confidential
We may implement or ignore feedback at our discretion
11. Disclaimers and Limitations of Liability
12.1 "AS-IS" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
ACCURACY, RELIABILITY, OR COMPLETENESS OF AI ANALYSIS
UNINTERRUPTED OR ERROR-FREE OPERATION
SECURITY OR PRIVACY PROTECTIONS
THERAPEUTIC EFFICACY OR CLINICAL OUTCOMES
11.2 No Medical or Professional Advice
SPACE OF MIND DOES NOT PROVIDE MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, OR THERAPEUTIC ADVICE OR TREATMENT. AI-GENERATED CONTENT IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR:
Lost profits, data, or opportunities
Indirect, incidental, consequential, or punitive damages
Damages from your use or inability to use the Service
Damages from unauthorized access, data breaches, or security failures
Damages from errors, interruptions, or inaccurate AI analysis
Damages from reliance on AI-generated content
Damages from actions or inactions of Therapist Partners
Damages from recording without proper consent
MAXIMUM LIABILITY: Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of:
$100 USD, or
The amount you paid us in the 12 months preceding the claim
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
11.4 Exceptions
Some jurisdictions do not allow limitations on implied warranties or liability for certain damages. If these laws apply to you, some limitations may not apply.
12. Indemnification
You agree to indemnify, defend, and hold harmless Space of Mind, its affiliates, officers, directors, employees, agents, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any law or third-party rights
Your User Content, including recordings made without proper consent
Your failure to obtain consent before recording
Any claim that your User Content infringes or violates third-party rights
Misrepresentation of your credentials (for Therapist Partners)
This indemnification survives termination of these Terms.
13. Dispute Resolution
13.1 Informal Resolution
Before filing a claim, you agree to contact us at developer@spaceofmind.com to attempt informal resolution. We'll attempt to resolve the dispute within 60 days.
13.2 Binding Arbitration
If informal resolution fails, disputes will be resolved by binding arbitration rather than in court, except:
Small claims court actions (under $10,000)
Injunctive relief for intellectual property violations
Arbitration Terms:
Governed by the Federal Arbitration Act
Administered by JAMS under its Streamlined Arbitration Rules
One arbitrator, mutually agreed or appointed by JAMS
Location: Delaware or mutually agreed location
Each party pays their own attorneys' fees unless awarded by arbitrator
13.3 Class Action Waiver
YOU AND SPACE OF MIND AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
13.4 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13.5 Venue
To the extent arbitration does not apply, you agree that any legal action must be brought in state or federal courts located in Delaware.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Space of Mind regarding the Service.
14.2 Modifications
We may update these Terms at any time. We will notify you of material changes via:
Email to your registered address
In-app notification
Posting on our website
Continued use after changes constitutes acceptance. If you don't agree, you must stop using the Service.
14.3 Severability
If any provision is found invalid or unenforceable, it will be enforced to the maximum extent possible, and remaining provisions remain in effect.
14.4 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
14.5 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or successor.
14.6 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, internet outages, etc.).
14.7 Survival
Provisions that by their nature should survive termination (including IP rights, disclaimers, indemnification, and dispute resolution) will survive.
